1. Important information and who we are

This privacy notice explains how Tessitura Network, Inc., a non-stock, nonprofit corporation organized and existing under the laws of the State of Delaware with its business address located at 11700 Preston Road, Suite 660 PMB 214, Dallas, TX 75230, U.S. (“Tessitura”, “we”, “us” or “our”) collects and uses Personal Information from individuals who engage with us outside of users of our products and services. This includes, but is not limited to, visitors to our website at www.tessitura.com (the “Website”), event participants, business contacts, and others who communicate or interact with us through various channels.

2. Information we collect and receive

"Personal Information" is information relating to an identified or identifiable living individual. We collect and use Personal Information for our own purposes as a data controller. The categories of Personal Information that we collect and use include:

  • "Identity Data" including first names, last names, marital status, title, date of birth and gender. 
  • "Contact Data" including email addresses and telephone numbers.
  • "Technical Data" including internet protocol ("IP") address, login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, device ID and other technology on the devices you use to access the Website.
  • "Transaction Data" includes details about payments to and from individuals and other details of services purchased from us, which can sometimes (although not always) contain Personal Information.
  • "Profile Data" includes your username and password for the Website, purchases or orders made by you, your interests, preferences, feedback and survey responses.
  • "Usage Data" includes information about how you interact with and use the Website. 
  • "Marketing and Communications Data" includes your preferences in receiving marketing from us and our third parties, records of your attendance at events, communications exchanged with us, and your communication preferences.

We also collect, use and share anonymised and aggregated data such as statistical or demographic data which is not Personal Information as it does not reveal your identity.  

3. How we collect Personal Information about you

We use different methods to collect data from and about you including through:  
  • Direct Interactions: You may give us your Personal Information by filling in online forms or contacting us by post, phone, e-mail or other means – for example, when requesting marketing, entering a competition or survey, or sending feedback to us.
  • Automatically: As you interact with our Website, we will automatically collect Technical and Usage Data about your equipment, browsing actions and patterns.   • Other third-party or publicly available sources: We may receive Personal Information from third parties and other publicly or generally available sources including other websites.

The law requires us to have a legal basis for collecting and using your Personal Information. We rely on one or more of the following legal bases:

  • Performance of a contract with you: Where we need to perform the contract we are about to enter into or have entered into with you.
  • Legitimate interests: We may use your Personal Information where it is necessary to conduct our business and pursue our legitimate interests, or those of a third party. We make sure we consider and balance any potential impact on you and your rights before we process your Personal Information for our legitimate interests. We do not use your Personal Information for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law).
  • Legal obligation: We may use your Personal Information where it is necessary for compliance with a legal obligation that we are subject to.
  • Consent: We rely on consent only where we have obtained your express agreement to use your Personal Information for a specified purpose.

5. Cookies

We use cookies, pixels, and other similar technologies (collectively, "Cookies") to distinguish you from other visitors to our Website. This helps us to provide you with a better experience when you browse our Website, and also allows us to improve the Website and our products and services. 6. Recording of support calls relating to our services

We record telephone conversations on our support line for quality monitoring, training, compliance, and security purposes. This practice is in line with applicable data privacy laws, ensuring that Personal Information is processed fairly and lawfully.

All inbound and outbound support calls made to or by us are recorded and retained for 90 days. Recordings are accessible only to senior members of our staff with permission, treated confidentially, stored securely, and destroyed once no longer needed. Payment details are never recorded.

You will be informed about the recording at the beginning of the call through a recorded message for inbound calls and a verbal notification for outbound calls. You are free to object to call recording at any stage during a call by notifying our support staff member. The support staff member will discuss your options with you, including ceasing recording of the current call and ceasing the recording of future calls.

Call recordings are securely stored and access is controlled by our authorized personnel, and is granted only for specific business needs. Requests for access must be formally authorized and include details such as the reason, date and time of the call, and telephone extensions used. You have the right to access your recorded calls under applicable data privacy laws. 

7. Marketing and Communications

Direct Marketing: We may use your Identity, Contact, Technical, Usage and Marketing & Communications Data to form a view on what we think you may want or need, or what may be of interest to you. You may receive marketing communications from us about our services if you have requested information from us or purchased products or services from us, or if you provided us with your details when you entered a competition or registered for a promotion and, in each case, you have not opted out of receiving that marketing. 

Third-party marketing: We will always first obtain your express consent before we share your Personal Information with any third party so that they may market their own products or services to you.

Opting out: You can ask us to stop sending you marketing communications at any time by following the opt-out links on any marketing message sent to you or by contacting us at privacy@tessituranetwork.com. You can ask third parties to stop sending you marketing messages by following the opt-out links on any marketing message sent to you. Where you opt out of receiving marketing messages, you may still receive service-related communications that are essential for administrative or customer service.

8. Links to other websites

We assume no responsibility for any content, information collected, terms and conditions or privacy rules maintained on any linked third party website and we strongly encourage you to examine the privacy policies contained on these websites. Please inform us by email to privacy@tessituranetwork.com about any concerns you may have regarding any of our linked websites.

9. Disclosures and onward transfers of your Personal Information

We may share your Personal Information where necessary with the parties set out below for the purposes set out in the table:

  • Affiliated companies within the Tessitura group of companies globally;
  • Third party business partners that support our operations, such as our partner organisations, vendors, subcontractors, and advertising and analytics providers;
  • With clients, where necessary to support the delivery of our products and services;
  • With law enforcement, governmental bodies, professional advisors or third parties if required to comply with legal obligations, enforce our terms, protect our rights, property, or safety – including for the purposes of cybersecurity or fraud protection; and
  • With other third-parties, with your consent.

We require all third parties to respect the security of your Personal Information and to treat it in accordance with the law.

We may disclose aggregated and anonymised data about Website users without restriction.

10. International transfers

In order to provide administrative services, IT support and maintenance and disaster recovery, Personal Information may be managed within the group of Tessitura companies to be accessed by employees in our overseas offices, involving transfers of Personal Information to and from the US, the UK, the EEA, Australia and New Zealand.

Whenever we transfer Personal Information internationally, we always ensure that security and protection is afforded to it by using contractual terms to impose appropriate standards and requirements of confidentiality, IT security and privacy.

11. Data security

The security of your Personal Information is important to us. While no set of privacy and security standards are completely secure, we have put in place appropriate security measures to protect your Personal Information from loss, misuse or unauthorised access.  

We have put in place procedures to deal with any suspected Personal Information breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

12. Data retention 

We may retain your Personal Information for as long as reasonably necessary to fulfil the purposes described in this privacy notice, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your Personal Information for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you, enforce our rights, or otherwise comply with a legal obligation.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

We will usually keep basic Personal Information about you (including Contact Data and Identity Data) for seven years after our last contact with you.

13. Your legal rights

Under certain circumstances, you have the following rights under data protection law:

  • Request access to your Personal Information (commonly known as a "subject access request").
  • Request correction of your Personal Information that we hold.
  • Request erasure of your Personal Information in certain circumstances.  We may not always be able to comply for specific legal reasons which, if applicable, will be notified at the time of the request.
  • Object to processing based on legitimate interest, unless compelling grounds are demonstrated that override your rights. 
  • Request the transfer of your Personal Information to themselves or a third party in a structured, commonly used, machine-readable format.
  • Withdraw consent for processing at any time, though this will not affect prior processing.  This may limit your access to certain products or services, and we will advise if this is the case.
  • Request restriction of processing of your Personal Information.

You can exercise your rights for free, but we may charge a reasonable fee or refuse requests that are clearly unfounded, repetitive, or excessive. We may request identity verification before fulfilling rights requests and may ask for additional details if needed. 

We aim to respond to all legitimate requests within one month, but will notify if it takes longer. To exercise any these rights, please contact us using the details below.

14. California residents

Under California law, California residents who have an established business relationship with us may make a written request to us about how we have shared their Personal Information with third parties for direct marketing purposes during the prior calendar year. If you would like to access, correct or request deletion of your Personal Information in our possession please follow the cost-free procedures set out at section 13 above. 

15. Age of Website visitors

We do not knowingly collect, maintain, or use Personal Information about children under the age of 13 and request that persons under the age of 13 not to use our Website. If you think your child has accessed our services, and has shared their information with us, please contact us using the details provided below.

16. Your rights to lodge a privacy complaint

If you believe your Personal Information has been mishandled or your privacy rights have been breached, you have the right to lodge a complaint with your local data protection authority. We would, however, appreciate the opportunity to address your concerns directly beforehand and invite you to contact us via the details below. 

17. Changes to the privacy notice and your responsibility to inform us of changes

We keep our privacy notice under regular review. It is important that the Personal Information we hold about you is accurate and current. Please keep us informed if your Personal Information changes during your relationship with us, for example a new address or email address.
